What Does an Attorney Actually Do?


Depending on the type of LPA, your attorneys may be responsible for:


  • Property & Financial Affairs: managing bank accounts, paying bills, overseeing investments, even selling property.


  • Health & Welfare: making decisions about care, medical treatment, and day-to-day well-beingThese are very different roles — and that’s why your choice of attorney needs careful thought.


You Don’t Need the Same People for Both LPAs


It’s a common misconception that your attorneys must be the same across both LPAs. In fact, you can (and often should) choose different people depending on their strengths.


  • For Health & Welfare, many people choose someone nurturing, empathetic, and emotionally attuned to their needs.

  • For Property & Financial Affairs, you may prefer someone practical, financially literate, and able to manage paperwork and long-term planning


Each LPA is independent, and you can tailor your attorney choices accordingly.

If You Own a Business: Consider a Business LPA


If you’re a company director, sole trader, or business partner, a standard LPA may not be enough.


Your business could be at risk if you lose capacity — and that includes decisions around staffing, contracts, suppliers, and regulatory obligations.


A separate Business LPA allows you to appoint someone with the specific knowledge, skills, or qualifications required to keep things running. It’s not just about competence — in some cases (e.g. regulated professions), legal authorisation may be required to act on your behalf.


This ensures your personal life and professional affairs are both protected, without one compromising the other.


What to Look For in an Attorney


  • Trustworthiness – this person could one day control your money and your care

  • Good judgment – not just about what you would want, but how to navigate situations calmly

  • Availability – attorneys should be able to step in when needed (not just in theory)

  • Understanding – do they know your values, preferences, and personality?


You can appoint multiple attorneys and decide whether they act jointly, independently, or in a combination. You can also name replacements in case someone is unable to act.


Common Mistakes to Avoid


  • Choosing someone just because “they’re the eldest” or “it’s expected”

  • Appointing joint-only attorneys who may struggle to agree

  • Forgetting to explain your wishes clearly

  • Overlooking the value of appointing someone professionally qualified to act in a business capacity
